How old is the I-9 form?

Form I-9, officially the Employment Eligibility Verification, is a United States Citizenship and Immigration Services form. Mandated by the Immigration Reform and Control Act of 1986, it is used to verify the identity and legal authorization to work of all paid employees in the United States.

Current beneficiaries who want to maintain their status must re-register from Oct. 24, 2023, through Dec. 23, 2023. Secretary of Homeland Security Alejandro Mayorkas rescinded the termination of the designation of Honduras for Temporary Protected Status (TPS) and extended TPS for Honduras for 18 months, from Jan. 6, 2024, through July 5, 2025. Current beneficiaries who want to maintain their status must re-register from Nov. 6, 2023, through Jan. 5, 2024. Secretary of Homeland Security Alejandro Mayorkas rescinded the termination of the designation of El Salvador for Temporary Protected Status (TPS) and extended TPS for El Salvador for 18 months, from Sept. 10, 2023, through March 9, 2025. Current beneficiaries who want to maintain their status must re-register from July 12, 2023, through Sept. 10, 2023.

Given a political climate trending toward enforcement, coupled with the increased penalties approved by the Department of Homeland Security, employers should make I-9 compliance a focus. Consider giving your human resources department a formal training on the new form and/or the proper procedures to conduct a self-audit. The new I-9 form is a “smart” form, an editable PDF with prompts to help ensure information is entered correctly. This allows the form to be completed on the computer and with fewer errors.

Completing Form I-9

COVID-19 temporary flexibilities for Form I-9, Employment Eligibility Verification, will end on July 31, 2023. S. Immigration and Customs Enforcement (ICE) recently announced that employers must complete in-person physical document inspections for employees whose documents were inspected remotely during the temporary flexibilities by August 30, 2023. A new Form I-9 can also be completed if major errors (such as entire sections being left blank or Section 2 being completed based on unacceptable documents) need to be corrected.
